Mumbai: Priyanka and Mitu Singh, sisters of late actor Sushant Singh Rajput, on Tuesday petitioned the Bombay high court to set aside an FIR filed against them by Bandra police based on actor Rhea Chakraborty’s complaint alleging forgery and procuring fake medical prescription for him. A bench of Justices S S Shinde and M S Karnik posted the matter for hearing on October 13, saying there was no urgency.
In her complaint filed last month, Rhea had accused the sisters of getting Sushant prescriptions of certain banned medicines under the telemedicine rules though he was already consulting doctors in Mumbai. She claimed the medicines that were given in “conspiracy with a Delhi-based doctor on a false prescription may have resulted in a chronic anxiety attack and resulted in Sushant’s suicide”.
The sisters, in their petition, said the actions of Rhea and Bandra police were “unreasonable and arbitrary” and the FIR makes no case against them and should be set aside. There is no evidence to show the medicines prescribed were administered to Sushant or anyone else, they said. “The FIR has been lodged on a very vague complaint based on alleged conjectures and surmises with ulterior motive to frame us.” They added that Rhea has “conveniently changed her stand and is now claiming that Sushant was a drug addict and had mental health issues” to tarnish his image.
The petition pointed out that the FIR could not have been filed without obtaining an expert opinion since allegations have been made against a doctor and that “only an expert can determine whether alleged prescribed medicine was clonazepam”. The FIR is malicious, alleged the sisters and narrated how their brother was “tragically found dead” on June 14, and and how their father was forced to file an FIR in Bihar due to “inaction” in Mumbai as the police “declared it a suicide” .
They claimed that Mumbai Police initially did not file an FIR in their brother’s death, and is now “supporting” Rhea and attempting to “derail and influence the CBI investigation”.
They alleged that the FIR was false and full of discrepancies, besides being filed belatedly—90 days after she left Sushant’s Bandra house on June 8.
The sisters sought a direction to the CBI to not take any coercive steps against them. Mumbai police had handed over the FIR to the CBI, in keeping with SC order, said Rhea’s lawyer Satish Maneshinde.
