Recently, Mallika Sherawat's film Dirty Politics, allegedly based on the Bhanwari Devi sex scandal in Rajasthan, got a notice from the High Court of Hyderabad to respond within four weeks, basis a PIL filed there. The PIL alleges obscene use of the Indian tricolour and an insult to national honour.

The film's poster shows Mallika sitting on top of an Ambassador with a lal batti, outside the State Legislative Assembly of Rajasthan, holding a CD in her hand, draped in a cloth showing tricolours used on the Indian national flag.

We believe that there is no monopoly on anyone using the colours of the tricolour for any purpose. The tricolour by itself does not become the Indian national flag. The Indian flag is complete only once the horizontal lines with all three colours in its defined proportions and the Ashok Chakra, consisting of all 24 spokes, is a part of it. That apart, the tricolours used in any way, be it individually or together, be it on any piece of clothing or accessory or designed in any way, cannot be construed as disrespecting the Indian national flag. Nobody has a monopoly over the colours of the tricolour and it's upto the individual to design or depict it in any way they deem fit creatively.
