Sanjay Dutt's lawyer says he did not seek remission

Swati Deshpande (THE TIMES OF INDIA; September 26, 2015)

Sanjay Dutt, who is out on a 30-day parole, will surrender to the Yerawada jail in Pune on Saturday and his legal team said former Supreme Court (SC) judge Markanday Katju had made a plea for his pardon in the case. The actor, who is undergoing a five-year prison term for his conviction under the Arms Act for illegal possession, more than two decades ago, of an AK-56 rifle, completes the sentence early next year.

Dutt's lawyer Hitesh Jain said the Maharashtra governor's refusal to reduce his term was not in response to any plea by the actor. “Dutt had not even asked for remission. The governor's refusal has to do with an earlier move by Justice Katju.“

Dutt had applied for parole on March 26 for his daughter's surgery in April, but got out of prison on August 26 (the surgery had taken place as scheduled). In the past month he spent time with family and friends, and directors and producers visited him too. They are said to be waiting for his prison term to end. Among those who dropped by were Vidhu Vinod Chopra and Sanjay Gupta, sources said. “Furlough and parole granted to Dutt are legally granted within the framework of the rules,'' said Subhash Jadhav, who may accompany the actor to Pune. “Like applications for other convicts are considered for furlough and parole, his were too.Hundreds of convicts are released on parole and furlough every year,'' he said.

The governor's refusal was on an application by Justice Katju on behalf of not only Dutt but also Zaibunissa Kazi, another convict in the 1993 Mumbai bomb blasts case, who unlike Dutt was convicted under the Terrorist and Disruptive Acti vities (Prevention) Act (Tada).

Jain said, “Neither Dutt nor his family members approached the former SC judge. Justice Katju had suo motto made the application for pardon in 2013.'' Dutt, after factoring in remission under the prison roles, is likely to complete his term in January, according to his lawyer's calculation, while the state says it may be in February.

Governor Ch Vidyasagar Rao decided the two-year-old pardon plea on September 15, on the recommendation of the home department, which cautioned that it may become a precedent, not a good one, as the Supreme Court had upheld his conviction and reduced his prison term by a year.

Justice Katju was not questioning the SC verdict but only the quantum as Dutt had already spent 18 months in prison when the apex court confirmed his conviction in March 2013.

Sanjay Dutt has been granted a 30-day parole for his daughter’s nose surgery. In June, Dutt had applied for parole citing his daughter’s illness. The parole application of the actor was accepted by the Pune divisional commissioner two days ago and the actor will soon be back with his family after finishing formalities. As per reports, the 30-day parole can be extended for another 60 days. If this happens, the actor will be with his family for the next three months. The actor has been serving his jail term after he was booked in the case for possession of illegal weapons as well as destruction of evidence under the Arms Act in the 1993 Mumbai bomb blasts case.

The actor’s five-year sentence began in May 2013, since then, Sanjay has been out of the prison on various grounds for a total of 146 days. After Dutt surrendered in May 2013, within months he was out on furlough in October 2013, which was later extended by 14 days. Following this, in January 2014, he was granted parole for 30 days, the actor got an extension of 60 days to this. Then again last December, the PK actor was out on furlough for 14 days, though the actor wanted to extend it, but it did not happen after heated debates and criticism from the media.

According to Vijay Satbir Singh, principal secretary, (Home), “We have been informed that the Pune divisional commissioner has approved the parole application and Dutt will be out after completing the formalities.” Dutt’s lawyers had requested the home department in last week of July, requesting the instructions to the divisional commissioner within the stipulated period of 45 days of the application. According to reports, Sanjay is likely to get remission of 30 days at the end of the completion of the jail term.

Does Nana Patekar want people to boycott Sanjay Dutt's films?

Notwithstanding the support of Bollywood bigwigs to Sanjay Dutt, Nana Patekar on Thursday slammed the extension of parole to the jailed actor, saying he would never work with the convicted star.

The 63-year-old actor said the least he can do is boycott the films that Dutt stars in.

Nana Patekar has broken ranks with Bollywood over Sanjay Dutt's parole issue. "I have not worked with him in 22 years of my career, I will not work with him in future too," the actor told a news channel.

"Government will do whatever they want. They are saying that it is legal, you can't say anything about it. But I will do whatever is in my hands," he added.

Dutt, 54, was convicted by the Supreme Court for illegal possession of arms in connection with the 1993 Mumbai serial blasts case and was sentenced to six years of imprisonment.

He had earlier served 18 months of jail and had surrendered himself before a Mumbai court on May 18, 2013 to serve the remaining period of his imprisonment.

"You will watch his films and make him a hero and later you say he shouldn't get parole. Things don't work like that. What can I do? Who will listen to me? People think he is only an actor. I am also a common man but who will consider that," Patekar said.

Patekar had spoken out against Dutt even at the time of his sentencing, saying he should not be given a favourable treatment for being an actor. Dutt has drawn flak for getting parole of almost 100 days during his current jail term.

PK, Ungli makers assure Sanjay Dutt has completed shooting the film

Seema Sinha (BOMBAY TIMES; February 26, 2014)

Even as the Centre has sought a report from the Maharashtra government over repeated parole given to actor Sanjay Dutt — the matter is being studied by top cops and the local government — one knows for a fact that this is the incarcerated actor’s last parole for this year.

Keeping this eventuality in mind, one wondered about the fate of PK and Ungli, his two unreleased movies. A few days ago, Aamir Khan had said that Dutt’s work in PK was incomplete and hence, the movie’s release was pushed to December. The Bollywood superstar, who shares screen space with Dutt, clearly stated that this was one of the reasons why his next release was pushed from June 6 to December 25.

However, what is truly baffling is that there is a serious disconnect between Aamir and director Rajkumar Hirani’s spokesperson’s versions. “We have finished shooting,” the spokesperson said. Ditto with Rensil D’silva, director, Ungli. Said Rensil, “Nothing from Sanjay’s side is pending. In fact, I finished his portions even before he went to jail. I’m ready for the May 23 release.”

Meanwhile, when asked to explain the parole privileges given to Dutt, Rakesh Maria, the Mumbai Police Commissioner, said, “I have asked my assistant commissioner to send me the file as I need to study the matter and then take a call on the case. Just give me a day or two.”

The law of the land states that parole can be granted only under exceptional circumstances. What these circumstances are, the court can decide depending on the facts of the case. Having said that, the illness of a wife and her inability to look after kids cannot be an exceptional circumstance to extend the parole. Assuming humanitarian grounds such a parole can be considered once for the illness of a near and dear one, but asking for it every time means taking advantage of the situation. Public perception is that he is an actor and is using his clout to get parole. Assuming his wife’s illness is prolonged, he cannot stay home for so long. What about others who are facing similar charges?
