Bombay HC says CBI gave no reasons, as mandated for LOC against Rhea Chakraborty, family; quashes them

Mumbai: No reason has been mentioned in the Look Out Circular (LOCs), as to why their issuance was warranted by the Central Bureau of Investigation (CBI), except for mentioning and giving a gist of the FIR, observed the Bombay High Court quashing the ones issued against Rhea Chakraborty, 31 and her brother Showik, 27, and parents Lt. Colonel Indrajit Chakraborty, a retired Indian Army officer, and Sandhya Chakraborty (Veteran), 57, in connection with the suicide abetment case of actor Sushant Singh Rajput in 2020.

The HC on Thursday pronouncing its ruling in three separate quashing petitions filed by Rhea, Showik and her parents said there was nothing to show that the LOC issued has been reviewed after 2020. The case had after an August 2020 order of the Supreme Court been transferred to the CBI.

A division bench of Justices Revati Mohite Dere and Manjusha Deshpande said what is “pertinent’’ was that it is not even the CBI case that the petitioners, except Rhea, is a flight risk. “All the petitioners have roots in India,” the HC observed adding the right to travel is a fundamental right which can’t be curtailed without reason, especially when LOC guidelines mandates reasons be given.

The Chakraborty family argued that the LOC was wrongly issued and amounted to an unwarranted flouting of their fundamental rights.

The CBI said it was issued against Rhea on a “reasonable apprehension of her fleeing away and not joining the investigation or trial.’’

The HC said the reason was not mentioned in the LOC, which only mentions the FIR and contents of the FIR.

The HC said when it questioned the special PP whether in every CBI case, on registration of an FIR, an LOC is issued, the answer was in the negative. “It is thus clear that clause (H) which mentions “reasons for opening LOC” means recording of the satisfaction of the authority for issuing LOCs. It is pertinent to note, that LOC is issued where the accused is deliberately evading arrest or not appearing in the trial Court despite non-bailable warrants and other coercive measures or there is a likelihood of the accused or person leaving the country to evade prosecution…’’

In neither LOC was any satisfactory reason given as required under the “consolidated guidelines’’ the HC said adding in any case the Chakrabortys participated and cooperated with the investigation and were last called for questioning in September 2021.

Besides, there s there is already a condition imposed on the petitioners-Showik and Rhea, in an NDPS case, not to leave the country, without the permission of the Court, the HC added.

The HC refused a plea by CBI for a stay of its judgment.

What Rhea Chakraborty has gone through… how will she heal from this?, asks mother Sandhya Chakraborty

Mumbai: “There is a God,” stuttered Sandhya Chakraborty as she let out a hushed cry, overcome with emotion when she learnt her daughter Rhea had finally been allowed to walk out of Byculla jail, after almost a month in judicial custody, reports Mohua Das.

The anxiety preceding this was acute for the family. “Rhea’s father was on the verge of collapse yesterday,” said the mother, as on Tuesday, an NDPS court had extended Rhea and Showik’s custody. “What she has gone through… how will she heal from this? But she is a fighter,” her mother told TOI.

As Rhea’s friends received her at the jail’s gate and brought her to her Santacruz home, Sandhya said her daughter could sit back for a while and recover from the “slander” and nightmare of “being lynched” by the country at large.

Mumbai: Rhea Chakraborty’s mother Sandhya told TOI on Wednesday that her daughter could sit back for a while and recover from the “slander.” “I will have to put her on therapy to help her get over this trauma and reclaim her life,” said the mother, aware that the legal battle might be a long one, with aspersions still being cast on her daughter. “While it’s a relief she’s out of prison, it’s crazy it’s still not over. My son is still behind bars and I’m paranoid about what tomorrow will bring,” she said, recounting how a neighbour’s recent claims of being informed by an eyewitness about Sushant Singh Rajput and Rhea being seen together on June 13 were “baseless” and an attempt to ride the tide. “We know this neighbour. She was a huge fan of Sushant’s who came over to our place to meet him once. Why she’d say something like this without proof is beyond me. One just has to look at Sushant or Rhea’s cellular location to know this whole thing is just another lie,” she said.

Fear of Covid and the terror of being mobbed by the media parked outside have kept Rhea’s parents holed up in their apartment. “The last time my husband stepped out to meet the ED, he was hounded on his way back. And he’s not the kind to fight back,” said Sandhya. “We panic every time the doorbell rings. We don’t know who it might be. There have been instances of reporters posing as CBI or as a resident of the building to come into our premises. We’ve installed CCTVs outside our door to secure ourselves.”

An alumnus of Armed Forces Medical College in Pune, Rhea’s father Indrajit Chakraborty, 55, was a surgeon for the armed forces for 24 years before he joined a hospital in Mumbai as administrative head. His wife, Sandhya, also 55, is a former schoolteacher. Indrajit is originally a Bengali from Kolkata while Sandhya is a Maharashtrian. The family has been living in Mumbai for close to 12 years.

As life in the household turned around dramatically over the past few months, Sandhya admitted to fighting her own suicidal thoughts. “I can’t sleep on the bed anymore when my children are suffering in jail. I can’t eat. I wake up in the middle of the night, gripped by a fear of the next thing that could go wrong. My family’s not just been pushed to a corner, it’s been destroyed. At one point, I thought the only way to end it was by ending my life,” she said. “I’m not this kind of a person, you know. I’ve sought therapy for myself. Now when these feelings appear, I keep reminding myself I need to be there for my children. They’re going through far worse.”

Sandhya broke down several times during the phone conversation with TOI, but was stoic in maintaining her children’s innocence. “We’re proud of our daughter. She’s maintained her poise and dignity even as she was pushed around, called names and landed with scratches on her face on way to the ED office. Yet, even after she came home today, she looked at us and said: ‘Why do you look sad, we have to be strong and fight this’,” the mother said. But the mother added, “But who are we fighting? Someone had to be arrested to satisfy the public, and Rhea paid the price. For loving and taking care of someone who she lost and then dragged through town for it.”

CBI files FIR against Rhea Chakraborty, kin, 2 associates

Cheating, Abetment To Suicide Charges

New Delhi: A day after the Centre issued a notification to hand over the probe into actor Sushant Singh Rajput’s death to the CBI, the agency on Thursday filed an FIR against actor Rhea Chakraborty and her family members Indrajit Chakraborty, Sandhya Chakraborty and Showik Chakraborty, besides Rhea’s associates Samuel Miranda and Shruti Modi. They are already being investigated by the Enforcement Directorate and have been questioned.

The FIR also mentioned ‘others’ in the accused column implying there may be more accused who are unidentified yet. The FIR was filed under sections pertaining to criminal conspiracy, abetment to suicide, wrongful restraint, wrongful confinement, theft, criminal breach of trust, cheating and criminal intimidation.

The CBI’s action is in keeping with the speed with which the Centre has responded to Bihar’s plea seeking a probe by the federal agency.

Authorities in Maharashtra have questioned the competence of Bihar police to launch a parallel probe into a case which was already being investigated by Mumbai Police. It has also opposed the demand for a CBI probe saying Mumbai police were conducting a diligent investigation.

The CBI probe into the Rajput case is arguably a first because the agency is barred from investigating cases falling under the jurisdiction of states unless requisitioned by the state government concerned or ordered by courts. In the current instance, the agency has stepped in on the basis of the request of a state government, i.e. Bihar, to probe a crime which took place in another state, Maharashtra. The SC’s stand on the matter might set a precedent or prevent one.

The CBI has only invoked the initial sections based on Bihar police’s FIR and the complaint given by Rajput’s father and can be modified at a later stage according to developments in the probe. The time period of the offence has been mentioned in the FIR as between June 8 and June 14. Rajput was found dead on June 14.

The case has been handed over to the anti-corruption Unit VI (SIT), New Delhi, given the economic aspects of the case and recent controversies, including a turf war between Mumbai and Bihar police. The SIT in CBI comprises joint director Manoj Shashidhar, DIG Gagandeep Gambhir and additional SP Anil Yadav among others. Yadav will be the investigating officer in the case. The CBI will collect case-related documents from Mumbai and Bihar police. It will also study the autopsy report and the statements recorded by Mumbai police before questioning the accused.
