Bewildered by this absolutely unsubstantiated attack against me & my daughter-Pooja Bedi

Meena Iyer (BOMBAY TIMES; December 22, 2014)

Pooja Bedi says she is appalled at the way lawmakers function. Three days ago, the actress was booked under the Protection of Children and Sexual Offences (POCSO) Act by the cops from the Oshiwara Police Station in a case involving a pub fight between her 17-year-old daughter's friend and the great granddaughter of filmmaker Ramanand Sagar. Things reached a head when Pooja's teenage daughter and she reportedly started to receive nasty messages from Sagar's great granddaughter and the girl's mother, Meenakshi.

To protect their interests, Pooja took it upon herself to file an FIR at the Versova police station against the Sagar kin. Of course, while she pressed charges, she showed the police officials all the evidence she had against the person she was complaining about. However, Pooja was in for a rude shock when the Oshiwara Police accepted a complaint filed against her by Meenakshi, that too under the POCSO Act.

Putting things in perspective, Pooja says, “How can the police accept a complaint against me when I wasn't even there at the scene of the fight that night? Surely they should have verified their facts before pressing charges against me.“

The actress says, “When I went to file my FIR, I was asked by the cops who were taking down my complaint to show them all the SMS, time stamps and everything else related to the matter so that they could accept my FIR. However, the Oshiwara police doesn't seem to have done that. They have just gone ahead and accepted Meenakshi's complaint against me without verifying anything. I have not been in touch with the other girl involved in the fracas. There are no nasty messages from my end to her. The only thing I have said in my messages to the people who were harassing my daughter is, 'Please do not involve us in this matter'. I have only done what is necessary as a mother to protect my child.

Aren't the police meant to protect citizens against wrong doing? Here it has become the classic case of the victim being victimised. My daughter and I are victims of someone else's vendetta. And we are being dragged into this when, in reality, we had no role to play. The actual pub fight was not even between my daughter and the Sagar scion. It was between the Sagar scion and my daughter's friend. My daughter only gave her friend a hug and now she is being targeted. Is it really so wrong to hug a friend in trouble?

I'm so beleaguered and bewildered by this absolutely unsubstantiated, unwarranted attack against me and my daughter. You have no idea what these people have done. They have brought up something on my dead mother; my relationship with my father and everything that is absolutely disconnected from the real issue. The FIR I filed is for protection; the case they are trying to implicate me in is false.“

When we contacted Meenakshi for her side of the story, she sent us this reply: “All my evidence against her (Pooja) to support my FIR is at the Oshiwara Police Station. There is no false allegation here. Please talk to the police there. Thanks.“

Subsequently, when we contacted Oshiwara Police Station for a comment, the officer who answered the call declined to respond to the query, saying that Sunday was Senior Inspector Subhash Vele's weekly off. Vele is the officer who was earlier quoted as saying that the Oshiwara Police Station has registered an FIR against Pooja and that the “matter is under investigation“. Calls to Vele's mobile went unanswered.

On a closing note, Pooja told us that Police Commissioner Rakesh Maria has assured her of justice in this matter.

THE CASE SO FAR
On November 28, Pooja Bedi's daughter and her friends clashed with the great granddaughter of late Ramanand Sagar at a popular club in South Mumbai. The matter escalated when Pooja and Meenakshi, the mother of the Sagar scion, filed complaints against each other.

Pooja filed a complaint at the Versova Police Station on December 3 stating that Meenakshi was drunk and had “made obscene gestures“ towards her daughter and her friends. This led to the mother being booked under the POCSO act and the Indian Penal Code (IPC) sections, which are Section 12 of the POCSO Act for 'unwelcome sexual remarks, emails or telephone calls', and IPC sections 500 (defamation), 506 (criminal intimidation) and 509 (word, gesture or act intend to insult the modesty of women). Meenakshi filed a complaint at Oshiwara Police Station around the same time, alleging that Pooja's daughter was drunk and even assaulted her.

The case saw a new twist when Pooja too was booked under POCSO Act by the Oshiwara Police on December 19 after Meenakshi said that Bedi's daughter and her friends had been “cyber bullying“ her daughter.

My daughter and I are victims of false case-Pooja Bedi

Have had no interaction with complainant's daughter, so how can I be booked under POCSO Act, socialite asks cops
MUMBAI MIRROR (December 21, 2014)

Two days after this newspaper reported that actress-socialite Pooja Bedi had been booked under the Protection of Children from Sexual Offences (POCSO) Act by the Oshiwara police in a case involving a pub fight between her 17-year-old daughter and the great granddaughter of late filmmaker Ramanand Sagar, Sakshi (Mom vs mom battle takes a nasty turn, MM, December 19), Bedi has said that she and her daughter have been victims of a "false case".

The pub brawl took place last month, and escalated into a feud between Bedi and the mother of Sagar's great granddaughter, and the two women filed counter-complaints.

While the Sagar scion has already been booked under POCSO by the Versova police following Bedi's complaint, the Oshiwara police last Thursday booked Bedi under the same sections, after the Sagar scion said Bedi's daughter and her friends had been "cyber bullying" her girl.

Bedi, however, told Mirror on Saturday that she has met with Police Commissioner Rakesh Maria, who has "assured her justice".

Saying the complainants haven't provided a single piece of evidence, Bedi told this newspaper: "I have had zero contact with her daughter. I have never met her, nor exchanged any SMS with her. How can the cops book me under Section 12 of the POCSO Act for 'unwelcome sexual remarks, emails or telephone calls'?"

Bedi's lawyer Rizwan Siddiquee said that his client being charged under POCSO Act was "abuse of power" and "belittling the essence of the Act meant to protect a child from any form of sexual abuse". "Bedi has never met the girl or had any type of interaction with her. She has only spoken to the mother after she called her up. When we approached the police station to register the complaint, cops were initially reluctant to register a case. It was only after we showed them evidence in the form of messages and emails, that a case was finally registered. But the current case has been registered with non-application of mind," Siddiquee said.

"When I filed my case, I submitted the SMS exchanges that my daughter and I had with the other party," Bedi said. "I gave them proof that they have been harassing us by putting out offensive posts against us on social media platform. I am shocked that the Oshiwara police didn't ask for the same evidence from the other party," Bedi said.

The actress added that the Sagar scion's complaint talks about her daughter's friends targeting the Sagar girl, then how come she and her daughter are being dragged into the mess. "Her complaint says that my daughter's friend bullied her daughter at a pub in November. She added that my daughter's friend abused her. Why is she attacking my daughter for what others have supposedly done to her girl?" Bedi asked.

Recounting the drama at the pub, Bedi said that the complainant demanded that her daughter reveal the name of her friend, which she refused. "The woman sent my daughter abusive messages till 4.30 am. My daughter told her not to use abusive language and gave my contact number to her. The next day, I received a message from her asking me to reveal the name of my daughter's friend, and I reverted saying keep us out of this. She then shot off hate messages against me, my daughter and our family. That's when I filed a police complaint," Bedi said.

The actress further said that Maria has told her he will probe as to how a first information report had been filed against her when she had no communication with the complainant's daughter. "Once it is proved that a false complaint had been filed, I will file another case against them," she said.

Meanwhile, the Oshiwara police hewed to the official line: Senior Inspector Subhash Vele from Oshiwara Police Station said, "We have registered an FIR and the matter is being investigated."
