Despite being less acquainted with politics, political-thriller Madamji actor Akshay Oberoi says field no different from Bollywood

Almost a decade after he made his industry debut, Akshay Oberoi says he’s finally getting roles that carry merit. Apart from Susi Ganeshan’s next, he will be seen in Subhash Kapoor’s political drama, Madamji. “Subhash has been a political journalist, so any conversation with him is a learning experience. He is objective, and doesn’t project his affiliations on the script, or the actor,” says Oberoi of the film that also stars Richa Chadha and Saurabh Shukla.

Even though he isn’t drawn to the subject of politics, Oberoi draws parallels between the field, and Bollywood. “Both industries are based on hierarchy. So I was able to internalise my character on that principle.”

A discussion on Kapoor cannot be complete without addressing the sexual harassment allegations that were levied against him by actor Geetika Tyagi. Prod Oberoi on the matter, and he says that though he has been supportive of the movement, he feels Kapoor is “stuck in a bad place”. “Some men have done horrific things, but most of the accused were put on social media trials. In this case, the matter is subjudice. I have known Subhash since his first film and he is among the best people I know. I didn’t jump into this film without doing research on the matter. I had enough access to find out about his previous [films]. Let’s note that there aren’t 10 people saying things against him. A filmmaker shouldn’t be stopped from working because of one allegation on him.”

Within hours of landing in Mumbai from the US, Tanushree Dutta was greeted with news that Aamir Khan has reversed his decision to not work with #MeToo accused director Subhash Kapoor on Mogul, a biopic on music baron Gulshan Kumar.

The superstar's reason behind his call — "I could not sleep at night because I used to feel that my actions have inadvertently caused a person, about whose guilt I have no idea, to lose his right to earn a livelihood" — earns a smirk from Dutta, who lived with her story of sexual harassment for a decade, before going public with it last year, thus opening the floodgates of the #MeToo movement in the country.

"How come nobody in Bollywood has sleepless nights when a woman becomes a victim of abuse and is not able to work due to the trauma and ostracisation," she questions, not afraid to call out the industry for its double standards. "If he has agreed to hire this guy [Kapoor], why not hire the woman [Geetika Tyagi] who suffered the consequences of his actions? Why do only the creepy men of Bollywood get compassion? Let the girls also see some of that saintly do-goodery."

In agreeing to work with a #MeToo accused, Dutta feels that Khan has defeated the purpose of the movement. "It was to heal the wounds of those who have no validation from court for the injustices they bore. Compassion should be universal. If it's so selective as is being displayed by the Bollywood's bigwigs, then it's not compassion. It's convenience and ignorance. Nobody bothered to ask me how I was doing when my livelihood was snatched away after the Horn Ok Pleassss (2009) harassment episode. No compassion for me, Aamir?"

Countering Khan's belief that one is innocent until proven guilty, the actor argues that only a survivor "understands the pain of having to see their perpetrators flourish while they wait for a court verdict that puts a stamp of approval on their complaint. If every alleged harasser gets reinstated, then the goal of an abuse-free workplace becomes a distant dream."

"This feels strange," says Geetika Tyagi, referring to Aamir Khan's recent decision to come on board Mogul. Only 11 months ago — at a time when the #MeToo movement had taken India by storm — the superstar had stepped away from the project, when it was brought to his notice that director Subhash Kapoor had been accused of sexual abuse by Tyagi in 2014. However, on Monday evening, the actor reversed his decision, stating that he is doing "what my heart says is right".

It won't be wrong to say that despite his best intentions, the association of Khan — one of the biggest superstars of Bollywood — with a #MeToo accused serves as a blowback to the movement. "I had commended Kiran Rao and Aamir Khan [last year] because it gave hope to more women to speak up about their own stories. But I had never asked for it from them. Now that Subhash has been hired back, it's not like someone [from their end] reached out to me. It would have been a fair game had they considered both sides of the story," reasons Tyagi, who had, in 2014, uploaded a video that corroborated her claims and saw Kapoor apologizing to her for his actions.

Explaining his change of heart, Khan stated that he had spent sleepless nights worrying that his actions had caused Kapoor to "lose his right to earn a livelihood." Bring this up with Tyagi, and she cuts in, "I have never said that Subhash shouldn't get work. But after I complained, I did not get work for a long time. The industry is patriarchal. Only women face the repercussions of complaining against sexual harassment, whether in the workplace or otherwise. They are ostracised when they complain. It's a sensitive decision on Aamir's part that Subhash shouldn't be treated badly until proven guilty. But what about my livelihood that has stopped since 2014? Criminal cases take time [to be served justice]and that's a reality."

In a statement, Khan also explained that he reached out to Kapoor's female colleagues "who spoke highly of him" before arriving at the decision. "People have to remember that if a person slips, he is careful next time around," she reasons. However, Tyagi asserts that the five-year legal battle has only made her stronger. She refuses to be discouraged by the superstar's decision. "Aamir re-hiring him doesn't affect my case, which is subjudice. I did everything by the book — went to the cops, filed charges, went to the lawyers. I believe in my fight, the system and I have my evidence."

Lauding the Mumbai Academy of the Moving Image (MAMI) for dropping projects featuring alleged sexual harassers from this year's festival, actor Geetika Tyagi has implored festival chair Kiran Rao and superstar Aamir Khan to re-evaluate the hiring of Subhash Kapoor to helm their home production Mogul, the Bhushan Kumar biopic.

After she urged Aamir Khan and Kiran Rao on Twitter to reconsider the superstar's collaboration with Subhash Kapoor on Mogul, actor Geetika Tyagi tells mid-day that it is up to the industry to carry the #MeToo movement forward. Tyagi, who accused Kapoor of sexual abuse in 2014 is appalled that the director has gone ahead to helm two films since then and is currently working on the Gulshan Kumar biopic.

"Subhash Kapoor was shooting for Guddu Rangeela (2015) when this started. After that, he bagged Jolly LLB 2. (2017) and now, he is doing Mogul. How is he still getting work? I hope Kiran and Aamir will decide wisely. I don't want them to rob someone of his livelihood, I want them to do the right thing," says Tyagi, who had even uploaded a video in 2014 that corroborated her claims. The video, which had gone viral, showed the director apologising to her for his actions and ended with Tyagi slapping him.

The actor agrees that over the years, there has been a positive change in the attitude of the industry towards survivors.

Pointing out how the Mumbai Academy of the Moving Image (MAMI), led by Rao, set a precedent by dropping films of the accused from this year's line-up, Tyagi adds that she hopes Rao exercises the same sternness with regard to her husband's production. "I have met Kiran once. She is a feminist, so I would want to believe that hiring Subhash is an oversight."

Tyagi has been fighting a lonely battle over the past five years. "The media failed me then. Though I found support initially, it fizzled out. I did everything by the book — I spoke up, named the guy, went to the police — and yet, I was fighting alone. There is no guild that protects actresses to take on men in power. I had second thoughts about being part of the industry. I stopped attending parties; I stopped hanging out. The next hearing is on January. And the trial is yet to begin."

However, the latest revolution has instilled faith in her. "The movement has gathered momentum. Justice will be served," she says.

Accused Kapoor was unavailable for comment at the time of going to press.

After two National Awards for Jolly LLB, how are you dealing with the pressure as Guddu Rangeela gears up for a July release?
There's absolutely no pressure. The National Awards may be a milestone in my brief career but I don't think it really matters to the audience how many awards anyone has won. They are interested in the movie. Period.

What's the film about?
It deals with khap panchayats, honour killing, with a tinge of the caste system thrown in, seen from the perspective of two happy-go-lucky orchestra singers. We've read of many such cases. There was one four years ago about a young couple killed despite a High Court order and police protection, which has been playing on my mind along with others. Like Phas Gaye Re Obama and Jolly LLB this one too is an issue-based film but the treatment is more mainstream - lots of action, drama, humour and thrills.

Anushka Sharma's first production, NH10, also touched on the same issue...
I've seen it, Navdeep (Singh) did a fantastic job. My film is set against the same backdrop, Haryana and Western UP. It's a world I'm familiar with, having travelled through this belt with friends when in school and college and later as a journalist, during the elections. And I can identify with the underdog since I too have humble origins. I never imagined I could become a journalist, let alone a filmmaker.

Was it a conscious decision to make another film between Jolly LLB and its sequel?
For a long time people have been urging me to make a Jolly LLB sequel but I didn't have a story. It was only towards the end of the Guddu Rangeela shoot, when 15 out of the 20 fans who approached Arshad (Warsi) for autographs at Chandigarh airport, asked him about Jolly LLB 2, that I decided to take a week and see if there was another Jolly inside me. (Smiles) Now I have at least half a dozen plot ideas for six Jolly films.

So are there plans to spin a franchise?
It will depend on whether part two works.The world of a 'hero' lawyer, his antagonist, and a judge who goes by the law in between the two, gives me the opportunity to touch on different issues and serious concerns. When I was doing the first film, I told my wife and the team, that if this didn't work, I wouldn't know what else to make. I'd accidentally stepped into this world in 1999 during the Delhi BMW hit-and-run case when the four correspondents covering courts were away and I was sent to cover the trial. It was my first visit to a court and I was fascinated. There lies the genesis of Jolly.

More recently, another hit-and-run case involving Salman Khan has been making headlines. Can it be the subject for a Jolly movie?
As a former journalist I'm the last person to give my verdict before the court. At the end of the day it's the job of the judiciary and we should respect the judgement. I'm told there was a lot of activity on Twitter about this case being the subject of the next Jolly LLB film but I have other stories to tell. Some other filmmaker can be inspired by it.

What's happening with the Geetika Tyagi molestation case?
I can't talk about it, it's subjudice.

Has it changed equations within the family and the film fraternity? There was talk that after the FIR was filed, producers of Guddu Rangeela considered pulling out?
Well, since the film is complete, they obviously didn't. And I don't think the behaviour of anyone in the film industry towards me has changed. I like to shoot my films in one schedule, away from Mumbai but when Amit Sadh hurt his foot, we had to take a three-month break. Fortunately, I'd shot for 10 days before the accident and edited those portions during the time. I also shot scenes that didn't require Amit. My producers stood by me through it all.

What's happening with the Munnabhai film you were to direct for Vidhu Vinod Chopra?
Munnabhai Chale Delhi was going to be my next film after Jolly LLB. It was about the world of politics and I was really excited. But then Sanjay Dutt went to jail and though Vinod and I are in touch, I have no idea what's happening with that film.

You can't make a Munnabhai film without Sanjay and Arshad?
No, I can't imagine any other actors as Munna and Circuit.

If not a Munnabhai film, can the script you were developing be turned into another film with different actors?
I don't rule out the possibility.

The Versova Police on Monday arrested National Award winning filmmaker Subhash Kapoor who is accused of molestation by actress Geetika Tyagi. According to the police, a constable was posted outside the residence of the filmmaker, who was supposedly out of town, and Kapoor was to be arrested upon return.

But Kapoor got wind of this and directly came to the police station on Monday morning accompanied by his lawyer. He was immediately arrested and produced in the Andheri court.

"We asked for police custody, but the court sent him to a 14-day judicial custody," an officer from Versova police station told Mirror on the condition of anonymity.

The director's lawyer then applied for bail which the court granted him, for a surety of Rs.10,000. Confirming the same, ACP Milind Bharambe told Mirror, "Subhash Kapoor was arrested yesterday and the court has granted him bail." When asked why the cops didn't push for his custody, Bharambe said, "It was the court's decision."

The National Commission of Women had written to Commissioner of Police, Rakesh Maria, asking him to explain why 3 of the 4 charges (304, 304A, 304B, 501) against the director were dropped and only the bailable section, 304, was retained.

Mirror was the first to report (February 19) the controversy which started when Geetika who has acted in films such as Aatma and One By Two, posted a link to a video which featured Kapoor, his wife, Aurangzeb director Atul Sabharwal, and her in the midst of a confrontation, apparently about Kapoor having sexually abused Geetika. Kapoor purportedly says in the video that he is ashamed of what happened between the two, and is ready to face the consequences. His wife adds that their life is ruined because of the said event and her priority now is to safeguard her son. The video ends with Tyagi slapping Kapoor, as Kapoor's wife sits by the table.

In her first interview to this newspaper (February 21) after the video was posted, Geetika asserted, "It is gratifying to shame the perpetrator." And added that Kapoor had called her a 100 times pleading with her not to go to the cops.

Commenting on Kapoor's arrest, Geetika said on Monday, "I'm relieved that he's been finally arrested. But had I known about the arrest, my lawyer would have opposed his bail application. But I'm sure he will be convicted after the trial."

Subhash Kapoor, who allegedly molested aspiring actress Geetika Tyagi, was arrested and produced in the Andheri Magistrate Metropolitan Court on Monday morning and released on bail on the same day.

In April this year, Tyagi had filed a complaint against Kapoor at the Versova police station alleging he had tried to rape her two years ago. The filmmaker was booked under sections 354 (outraging a woman's modesty), 354 A (sexual harassment), 354 B (attempting to disrobe a woman) and 501 (defamation) of the Indian Penal Code.

The actress had also uploaded a video that showed her slapping Kapoor. In the video, she is confronting the Jolly LLB director and accusing him of forcing himself on her and dragging her at a party held over a year ago. Geetika could not be reached for a comment, but Kapoor denied the news. “This is not true,” he said.

Meanwhile, ACP Samadhan Dhanedar of the Versova police station confirmed that Kapoor was arrested and let out on bail after paying a sum of Rs 10,000.

Filmmaker Subhash Kapoor, who is celebrating Jolly LLB’s double win in the recently announced National Film Awards — in the Best Film and Best Supporting Actor (Saurabh Shukla) categories — has left behind the Geetika Tyagi molestation controversy.

Early this year, the journalist-turned-actress had accused Subhash of molesting her. She said the incident had taken place at her residence about two years back. Soon after the controversy erupted, there were reports of the director and the actress planning to take legal course. It was even said that Subhash wanted to take legal action against Geetika for character assassination.

But it looks like the filmmaker, who has been keeping a low profile since then, is now keen to bury the past and get busy with work. He said, “As far as the case is concerned, I am not going to pursue it. I am not doing anything about it.” Geetika was not available for comment.

Director Atul Sabharwal’s show of support to actress Geetika Tyagi, who has accused filmmaker Subhash Kapoor of molestation, seems to have rubbed Yash Raj Films (YRF) the wrong way.

The industry grapevine is buzzing with rumours that Atul and Geetika have been dating since a long time and so when he supported her case on social networking platforms, YRF decided to part ways with him.

A source close to the production house said the director was working on his next film under the YRF banner but the deal is not on anymore. “YRF has never been embroiled in controversies, so Atul was called and it was decided that they would not be working with him,” said the source.

The production house, however, scotched the rumours, saying, “This is not true. Atul is working on his next script for YRF.” Atul, too, echoed the same. “This is completely baseless and untrue. I am working on my script for YRF,” his text message read.

The source, on the other hand, stuck to the ‘separation’ theory. “YRF has indeed parted ways with Atul, but at the same time they don’t want to make things messy by talking about it,” the source added.

Recent reports claimed that director Subhash Kapoor has gone ‘underground’ to avoid media scrutiny after being accused of molestation by actress Geetika Tyagi but Mirror has it that the filmmaker is busy shooting his next film in Shimla.

The production of his next, Guddu Rangeela, starring Arshad Warsi, Amit Sadh and Aditi Rao Hydari is in full swing in the hill station. A source told Mirror, “The mood on the set is quite upbeat and the shoot is progressing well. To avoid any upsetting incidents, Subhash has requested that nobody mention Geetika Tyagi's name or question him about the episode.”

When quizzed about the film’s subject, the source revealed, “It’s a classic satire on rural politics. Amit plays Guddu, a hardcore Haryanvi, while Arshad will be seen as Rangeela. The leading lady, Aditi Rao Hydari, plays a pretty school teacher.”

A major chunk of the film has been completed and the crew will now move to Narkanda, to shoot portions in heavy snow, before shifting base to Chandigarh.

Added the source, “The film’s outdoor shoot will be complete after the Chandigarh schedule. A few days in mid-April will be shot on a set in Mumbai and the film will be wrapped up.”

While Subhash Kapoor has moved on and is shooting his next film up North, Geetika Tyaagi after some explosive videos and tell-all interviews has been keeping a low profile. When contacted, the actress informed that she had relocated to Delhi for a while to be with her ailing father. “My father has not been keeping well. And I haven’t ventured much outside. Even though the videos with Subhash admitting to the act are online, people still point fingers at me and raise questions about my character. And that is very disturbing,” she confides. Asked why she’s not filed a police complaint, Geetika said, “I haven’t been in touch with my lawyer due to my father’s illness, but I can assure you that we will be taking some concrete steps soon.”

It’s a status quo in the Subhash Kapoor-Geetika Tyagi molestation case. While the director is still underground, the actress, who is yet to lodge a police complaint, says, “I will give you something concrete soon.” Geetika had recently accused Subhash of molesting her — after a party at her place in the Western suburbs of Mumbai — about two years back. She alleged that Subhash had tried to force himself on her and even tried dragging her into the bedroom. And some time last month, she posted a related video link on a social networking site. In the 30-minute video, Subhash appeared to be apologising to the actress, but denied any molestation. The video also shows Geetika slapping Subhash. 

A few days ago, there seemed to be a slight development in the case when a source mentioned that the actress was ready to settle the issue with the director. However, Geetika denied it vehemently. “Absolutely not. Who are these lame-minded people?” she asked. 

Repeated attempts to contact Subhash remained futile. Industry sources say that he is currently in Punjab, doing a recce for his next film. However, certain sources also say that the director is planning to take legal recourse.
 
TV SHOW AIRS TRACK BASED ON THE CONTROVERSY
Tanvi Trivedi TV shows have always been inspired by ‘real-life’ incidents, the latest being the Geetika Tyagi-Subhash Kapoor controversy. A telly show will air a track where one of the characters auditions for a film and the casting director/producer tries to molest her. According to a source, the production house decided to incorporate this track because they felt it will spread awareness about the issue.

It has emerged that journalist-turned-actress Geetika Tyagi, who is currently in the centre of a controversy involving her molestation allegations against filmmaker Subhash Kapoor, was fired by a news channel in 2004. It seems that Geetika stole news-anchor-turned-AAP party leader Shazia Ilmi’s ATM card and withdrew money using the same.

A source close to Ilmi says, “She (Ilmi) used to anchor the 7 pm news segment and Geetika would host the 10 pm slot. They shared a makeup room and often Shazia would leave her bag inside the make-up room, not realising that Geetika would fish out her ATM card from the bag and withdraw money from the bank.

Obviously, Ilmi was alarmed that her card was being misused; she even filed a complaint with the management." The source adds that when questioned, Geetika denied the accusations only to own up at a later stage. “She was shown CCTV footage that caught her in the act and immediately after, she was asked to resign from the organisation,” says the source.

Ilmi, who is currently in London, confirmed the story. “Yes, the incident you mentioned is true,” she said.

Geetika, however, didn’t respond to either email or SMSes.

While actress Geetika Tyagi has decided to file a police complaint, director Subhash Kapoor, who she has accused of molesting her, has gone underground and cannot be contacted.

However, their common friend Danish Raza, scriptwriter, refutes charges laid by Geetika saying, “Geetika trapped Subhash by using me.” He further explains, “She had initially told me that ‘Subhash had got senti and he tried to come on to me (sic)’. She had further said that they got physical but they didn’t go the whole way and that she told him to stop and he stopped and left.” He further says, “Earlier, she had said that she went into the bedroom but later she changed her version saying Subhash had dragged her in the bedroom,” says Danish.

Says Geetika, “Let Danish say whatever he wants to in front of the police. I have not changed my version, it remains the same and I never spoke to Danish, Subhash has accepted it on camera that he is sorry, I have all the recordings. Both, Danish and his wife insisted I meet Subhash and sort out the matter. They have been discouraging me to go to the cops.”

While Geetika, in her interview says, that Subhash (who was introduced to her by Danish about seven years back), had been messaging her to meet him for some days (around mid-2012), Danish insists that Geetika had been pestering him to call Subhash for a get-together after the release of his second film, Phas Gaye Re Obama. “We would occasionally meet, but after the release of his second film she began pestering me to call Subhash for a gettogether,” says Danish.

Refuting her other allegation that he (Danish) would never go against Subhash as he was making inroads into Bollywood, Danish says, “The incident happened two years back and I was clearly on Subhash’s side. After that Subhash had two projects and I had nothing to do with them. I never worked with him commercially. If I would have had any commercial interest I would have sided with Geetika, who had taken me to Anurag Kashyap with a script, which I wanted to do with her in the lead. She had further put me on to Kumar Mangat and introduced me to many other filmmakers.” He further adds, “Geetika would say, ‘Apne hi log mujhe cast nahi kar rahe hain’. She was referring to Subhash, who had cast her in a film in a small role which never took off.” Geetika refused to reply to any other queries saying that she was issuing a press statement.

When did you first meet Subhash Kapoor?
I met him in 2005 through a common friend Danish Raza. He introduced us saying Subhash was a journalist from Delhi and since I too had covered crime for a news channel in Delhi, we got chatting. Over the next eight years I got to know him and his wife Dimple Kharbanda better and we’d meet up frequently. I have even seen his son grow up. They were like family. On May 28, 2012, I met Subhash at a restaurant in Andheri. I was with my sister and her friend. Danish was there too. Subhash had been messaging me to meet him for some days. We had beer, I wanted to call it a day, but Subhash insisted we stay on. Eventually, we decided to take the party to my place which was nearby and which Subhash had visited several times with his wife. My sister and Danish came along.
 
Then? 
Everybody left, including my sister as we were in the middle of shifting to a new house. Danish, a trusted confidante, and Subhash stayed back. This was the first time Subhash was at my place without his wife who was in the US. I told him politely that he should leave but he went into the bedroom and dozed off. Despite my insistence to stay, Danish excused himself saying he had to go to work early. The minute he left, Subhash woke up and started giving me pep-talk about life and relationships. He then came and sat next to me and forced himself on me. I went numb. This man was like an elder brother. I ran to the kitchen, he followed me, I abused him roundly. Somehow I texted Danish to call me and told him loudly on the phone, “Subhash is leaving right now.”
 
Why didn’t you raise an alarm? 
I was shocked and scared. He could have harmed me.
 
You could have reported the matter to the cops the next day...
Subhash and Dimple were family, I couldn’t just run to the cops. I wrote to his wife and made several calls to her. Danish insisted I meet Subhash and quietly sort out the matter. He told me that since I didn’t have any evidence, my case wouldn’t stand. I was aghast and realised then that being a scriptwriter, he’d never go against Subhash who was making inroads into Bollywood.
 
Did Subhash also pressurise you not to file a police complaint? 
He called me a hundred times and Dimple begged me to let go of the matter saying that not only would their lives be ruined, but also the future of their son. I convinced myself that this was the noble thing to do and somehow bottled up my rage. I lost out on work, my social life was nonexistent and I was petrified not just of strangers, but also people I knew.
 
So what triggered the move to come out in the open and upload the video almost two years later? 
Dimple had emotionally convinced me that their marriage was over and their life shattered after this incident. But nothing like this happened. Soon they were celebrating together while my anger and helplessness got unbearable. The Tarun Tejpal incident gave me the strength to come out in the open.  

Who made the videos? Was Subhash aware that he was being filmed? 
I did. The first time when I met him after the incident (on May 31, 2012), I told him I would record everything. (Shows Mirror another video) In this clip you hear me ask him angrily how he could have done such a thing. He doesn’t respond initially, as you see, but later says, “I thought you were vulnerable, like I was, but I ended up making a blunder.” .
 
Some believe that the video you uploaded was timed to coincide with a press release issued, asserting that a big film studio had signed Subhash for their next film.
I can’t stand the guy, you think I’ll keep track of what film he is making? During the Tarun Tejpal’s incident in November, Atul Sabharwal, who I had confided in, tweeted saying Subhash is a pervert. His wife came running and pleaded with me to delete the tweet. By now, I knew this was a con. We shot the whole thing on my iphone; and that’s the video we uploaded.
 
The Tarun Tejpal incident happened in November. Why did you wait till now to come out? 
I had two films coming up – What the Fish and One By Two -- in successive months. I didn’t want to seem like someone using the tragedy for cheap publicity.
 
But you still haven’t gone to the cops
I will be filing a police complaint anytime now. I wanted to first gather clinching evidence and put it out in the public domain. This will prove useful during police procedures. It’s not easy going to the cops. It takes years to gather that kind of courage. But it was gratifying for me, a victim of sexual abuse, to shame and humiliate the perpetrator who was family and never a filmaker. I still get nightmares.
