Films like Adipurush put to test the tolerance of Hindu, says Court

Lucknow: The Lucknow bench of the Allahabad High Court on Tuesday slammed the makers of the film 'Adipurush' and asked how the Central Board of Film Certification cleared the film for public viewing. The court observed that such films were putting to test the tolerance of Hindus and added that thankfully the community did not create any law and order situation. The court's observations, however, were not part of the order.
The court also directed for notice to be issued to Manoj Muntashir, the dialogue writer of the film, and make him a party in the case. The court's observations came while hearing two PILs filed by Kuldeep Tiwari and Naveen Dhawan seeking restriction on screening of the film.
The vacation bench of Justices Rajesh Singh Chauhan and Shree Prakash Singh asked deputy solicitor general SB Pandey to seek instructions as to whether the central government was contemplating to review the certificate granted by the Censor Board.
The bench has posted the matter for the next hearing on Wednesday
The bench declined to accept the plea that the disclaimer of the movie said that the movie was not based on the Ramayana. "When the filmmaker has shown Lord Rama, Devi Sita, Laxman, Lord Hanuman, Ravana, Lanka etc., how the disclaimer of the film would convince the people at large that the story is not from Ramayana," the bench reacted strongly.
The bench was irked when it was apprised by the petitioner’s lawyer, Ranjana Agnihotri, that the movie may not only affect adversely the sentiments of the people at large, who worship Lord Rama, Sita, Hanuman etc., but the manner in which the characters of Ramayana have been depicted would create serious disharmony in the society also. It was further stated that the petitioner failed to understand from where the content of the film had been borrowed as nothing in that manner has been narrated in Valmiki’s Ramayana or Tulsi Das’ Ramcharitmanas.
TIMES VIEW:
The CBFC is an official body entrusted with the job of looking into issues such as public morality and collective sensitivity before issuing a certificate permitting any film’s exhibition. Any issue with the film being allowed to screen should be addressed to CBFC, not the film’s makers.
Allahabad High Court stays arrest of Mirzapur producers

Prayagraj: The Allahabad High Court stayed on Friday the arrest of Farhan Akhtar and Ritesh Sidhwani, the producers of the web series “Mirzapur”, after an FIR was registered against them for allegedly hurting religious, social and regional sentiments through their portrayal of the eastern UP town of Mirzapur.
Hearing a writ petition filed by Akhtar and Sidhwani, a division bench comprising Justices Manoj Kumar Gupta and Subhash Chand also issued a notice to the state government and the complainant seeking their replies. The next hearing was listed for the first week of March.
Sidhwani and Akhtar had moved the HC after an FIR was registered in Kotwali Dehat, Mirzapur, against them under IPC Sections 295A (deliberate and malicious acts, intended to outrage religious feelings of any class by insulting religious beliefs), 504 (intentional insult with intent to provoke breach of peace) and under Section 67-A of the Information Technology Act.
The primary allegation against the producers was improper and indecent portrayal of the town of Mirzapur, which hurt religious, social and regional sentiments and could advance animosity.
Padmaavat banned in Haryana

Haryana has become the third BJP-ruled state after Gujarat and Rajasthan to ban the release of Padmaavat. According to Health Minister Anil Vij, the decision was taken by the state Cabinet keeping in view the law and order situation given that many feel historical facts have been “distorted” in the period drama which opens on January 25. Meanwhile, the Allahabad High Court issued a contempt notice to Central Board of Film Certification chairman Prasoon Joshi in connection with the release. The Lucknow bench of the court granted three weeks’ time to Joshi for filing his response to the contempt notice. It fixed next hearing of the matter in the week commencing February 12.
A bench of Justice Mahendra Dayal passed the order on the petition filed by Kamta Prasad Singhal, who had submitted that he had earlier filed a Public Interest Litigation seeking a ban on the film’s release because it promoted Sati, which is an offence. After hearing the PIL, the court had on November 9, 2017, dismissed the petition but, simultaneously, permitted the petitioner to move his grievance through a representation to the CBFC. Accordingly, he moved the representation before the chairman of the board on November 13, but Joshi is yet to decide on it and the three weeks time given to him by the High Court has lapsed.
